cosmicwheelplay.com (the “Site”), presented under the Cosmic Strike brand, and the free-to-play social browser games developed and operated by Cosmic Strike Ltd (including Cold Space, Spaceships, Nebula Raiders, Dark Castle, Temple of Athena, Valhalla, and related browser-based titles, each a “Game” and together the “Games”) — are operated by Cosmic Strike Ltd (“we”, “us”, “our”), a company registered in England and Wales (Company No. 15621027) with registered office at 11-12 Tokenhouse Yard, London EC2R 7AS, United Kingdom. These Terms & Conditions (“Terms”) govern your access to and use of the Site, the Games, and our Game Development request portal (together, the “Service”). By accessing the Site, playing the Games, or submitting a development request, you accept these Terms.

The Games are free-to-play, demo-style social games provided for entertainment purposes only. They do not offer, promote, or facilitate real-money gambling of any kind, and they do not provide casino services. No wagers of money or anything of monetary value are placed, accepted, or held by us at any time. The Service is not a gambling service within the meaning of the Interactive Gambling Act 2001 (Cth) and is not licensed or regulated as one in any Australian state or territory.

The Games do not award, and you cannot obtain through them, money, cryptocurrency, merchandise, vouchers, sweepstakes entries, or any other prize or benefit having real-world value. There are no withdrawals and no cash prizes. Practice or success at social casino gaming does not imply future success at real-money gambling.

Virtual coins, chips, spins, and any other in-game items (“Virtual Items”) are a functional part of the Games and exist only inside them. Your coin balance is shared across all Games on the Site. Virtual Items:

• have no monetary value and are not a currency, deposit, credit, stored value, or property of any kind;
• cannot be withdrawn, cashed out, exchanged for money, transferred to another user, sold, or redeemed for prizes or benefits of real-world value;
• are licensed to you for personal, non-commercial use within the Games and remain our property;
• may be granted, adjusted, expired, or removed by us, and may be lost if your account is closed.

You acquire no ownership right in any Virtual Item, and we owe you no compensation of any kind for Virtual Items that are lost, adjusted, expired, or removed.

Access to the Games is free. There are no purchases, deposits, subscriptions, or payments of any kind, and we do not request payment card details. If we introduce optional in-game purchases in the future, we will update these Terms and disclose the purchase terms before any purchase can be made.

You must be at least 18 years old to create an account or use the Service. By using the Service you represent that you meet this requirement. The Service is not directed at, and must not be used by, anyone under 18. We may request proof of age at any time and may suspend or close an account where we are not satisfied that the age requirement is met.

New accounts receive a one-time grant of 2,000 virtual coins, which can be used in any of the Games. Additional bonuses, including daily coin bonuses, may be offered from time to time. All bonuses are limited to one per person, per household, and per device, are granted in Virtual Items only, and are subject to the following: they carry no monetary value, cannot be withdrawn or exchanged, and may be modified, suspended, or withdrawn by us at any time. We may withhold or reverse any bonus where we reasonably believe it was obtained through duplicate accounts, automation, or other abuse.

You may hold one account, which gives you access to all Games on the Site. You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity under your account. Notify us at cosmicstrike@mailfence.com if you believe your account has been accessed without your authorisation. You may close your account at any time by contacting us or by using the account settings on the Site.

You agree not to: use the Service if you are under 18; create more than one account or use another person’s account; use bots, scripts, automation, emulators, or modified clients; exploit bugs or manipulate game results; attempt to sell, buy, or transfer accounts or Virtual Items; reverse engineer, copy, or scrape the Service; interfere with its operation or security; or use the Service for any unlawful purpose.

Game Development Request Form Rules: When using our Game Development inquiry form or submitting project specifications to our development team, you agree to provide accurate, lawful information. You must not submit, transmit, or upload any materials that are unlawful, defamatory, abusive, obscene, fraudulent, infringing on third-party intellectual property or privacy rights, or that contain malware, malicious code, or unsolicited commercial solicitations. Submitting an inquiry does not constitute a binding agreement or commitment to develop a game.

We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if we suspect fraud or abuse, if required by law, or if we discontinue the Service. On termination your right to use the Service and any Virtual Items ends immediately.

The Service, including the Site, proprietary games (Cold Space, Spaceships, Nebula Raiders, Dark Castle, Temple of Athena, Valhalla), underlying software, game mechanics, mathematical algorithms, text, artwork, textures, sounds, and our trademarks, is the exclusive intellectual property of Cosmic Strike Ltd and is protected by international intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your personal entertainment. All other rights are reserved.

Future Client Projects & Commercial Terms: Intellectual property rights, deliverables, licensing arrangements, and commercial rights for custom development projects are not pre-committed or granted publicly under these general website Terms. All client rights and developer deliverables for custom releases are determined solely and exhaustively by separate, mutually executed written commercial contracts.

We are an independent operator of free social games and are not affiliated with, endorsed by, or acting on behalf of any real-money gambling operator, casino, or licensing authority.

The Site may contain links to third-party websites placed under commercial arrangements. We do not control those destinations and are not responsible for their content, and a link is not an endorsement. Our commercial arrangements do not change how the Service works or what it offers. We aim to keep the Service available but do not guarantee uninterrupted access. We may add, modify, suspend, or discontinue any part of the Service, including individual Games and Virtual Items, at any time.

The Service is provided “as is” and “as available”, without warranties of any kind except those that cannot be excluded by law. To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential loss, for loss of data, or for the loss of Virtual Items.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you may have under the Australian Consumer Law or any other law that cannot be excluded, restricted, or modified by agreement. Where our liability for a failure to comply with a consumer guarantee can be limited, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

The Games are intended as entertainment. If your play stops feeling like entertainment, our Responsible Social Play page sets out warning signs, the self-limitation tools available on the Site, and free confidential support services in Australia.

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

We may update these Terms. We will post the updated version at cosmicwheelplay.com/terms with a new effective date and, where the change is material, notify registered users by email or by notice on the Site before it takes effect. Continued use of the Service after the effective date means you accept the updated Terms.

These Terms and any dispute arising out of them are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. This does not deprive you of the protection of any mandatory consumer protection rules of the country or state in which you live, including the Australian Consumer Law, and does not prevent you from bringing proceedings before the courts of your place of residence where applicable law gives you that right. If any provision of these Terms is found unenforceable, the remaining provisions continue to apply.
